Remote Year Affiliate Program, Remote Year Individual Referral
Program, And Remote Year Employer Partnership Referral Program Terms & Conditions

Remote Year’s Individual Referral Program allows active Remote Year Participants, Remote Year Citizens in good standing (as determined by Remote Year), Premotes/Potential Remotes (as determined by Remote Year), Remote Year employees, and individual Remote Year independent contractors (“Referrer” or “Referrers”) to earn Remote Year credits or money by referring friends to join a Remote Year program.

Remote Year’s Employer Partnership Referral Program allows active Remote Year participants, Remote Year Citizens in good standing (as determined by Remote Year), and Premotes/Potential Remotes (as determined by Remote Year) to earn Remote Year credits or money by referring their current employer to Remote Year’s Partnerships team.

Remote Year’s Affiliate Program allows influencers with no prior affiliation to Remote Year to apply for an affiliate link through which they may earn cash for referrals. Each Affiliate must be pre-approved by Remote Year. In order to qualify you must be an be an influencer or micro-influencer in a relevant space, and have a social media presence / message that is aligned with Remote Year's core values. Whether you may qualify to become an Affiliate is completely within Remote Year's discretion and Remote Year reserves the right to revoke affiliate status at any time and for any reason.

To participate in the Affiliate Program, the Individual Referral Program, or the Employer Partnership
Referral Program, Affiliate/Referrer must agree to these terms and conditions. Anyone that does not fit the
description of a Referrer above is not eligible to participate in the Referral programs and anyone that does not
fit the description of an Affiliate above may not participate in the Affiliate Program. Capitalized terms not defined here will have the same meaning they are given in
Remote Year’s Participant Terms and Conditions.

1. QUALIFIED REFERRAL (“Qualified Referral”)

A. For individual referrals. For any referred person (“Referred Person”) to be considered a Qualified Referral, such Referred Person must: (a) not have applied to Remote Year prior to the referral; (b) be an individual person (as opposed to an entity or a group of people); and, (c) submit a full down payment for, and commit to join, a 12 Month Remote Year program or a 4 Month Remote Year Program, within six months of (but not prior to) the referral Submission. In the event a Referred Person is referred more than once, only the Referrer that the Referred Person designates when they put down their down payment will be eligible to earn. If no Referrer is designated by the Referred Person, only the Referrer that made the referral first will be eligible to earn.

B. For employer partnership referrals. For any referred employer (“Referred Employer”) to be considered a Qualified Referral, such Referred Employer must: (a) be the Referrer’s current employer; (b) be an actual entity with multiple employees and/or independent contractors that would be eligible for a Remote Year program; and, (c) must sign a Partnership contract with Remote Year within twelve months of (but not prior to) the referral Submission. In the event a Referred Employer is referred more than once, only the Referrer that made the referral first will be eligible to earn.

C. For Affiliates.  For any referred person (“Referred Person”) to be considered a Qualified Referral, such Referred Person must: (a) not have applied to Remote Year prior to the referral; (b) be an individual person (as opposed to an entity or a group of people); and, (c) submit a full down payment for, and commit to join, a 12 Month Remote Year program or a 4 Month Remote Year Program, within six months of (but not prior to) the referral Submission.

Each Submission can only be made by a single Referer (no group submissions). Referrers may only complete a single Submission per potential person they would like to refer. Incomplete Submissions will result in ineligibility. Submissions for referral can be made by completing a referral form on the Remote Year Referral Program website that provides:

Contact with Referred Person

Following a complete Submission, we will contact the Referred Person confirming our receipt of the  Submission unless otherwise instructed to contact Referrer first. By agreeing to these terms and conditions and/or making a Submission, you hereby represent that you have obtained consent from the Referred Person to provide Remote Year with the Referred Person’s contact information for the purposes described in these terms. The Referred Person will have the opportunity to inform us that (a) they are not looking to join Remote Year; and/or, (b) they have not given authorization to you in connection with the referral. If the  Referred Person informs us that they have not  given authorization to you, you will not be eligible to earn even if such Referred Person becomes a Qualified Referral. Submissions that do not adhere to the procedures outlined in these terms will not be recognized as valid.

Contact with Referred Employer

Following a complete Submission, the Referred Employer will be contacted by Remote Year’s Employer Success Team. By agreeing to these terms and conditions and/or making a Submission, you hereby represent that you have obtained consent from the Referred Employer to provide Remote Year with the Referred Employer’s  contact information for the purposes described in these terms. The Referred Employer will have the opportunity to inform us that (a) they are not interested in a partnership opportunity with  Remote Year; and/or, (b) they have not given authorization to you in connection with the referral. Submissions that do not adhere to the procedures outlined in these terms will not be recognized as valid.

3. HOW TO EARN

4. MISCELLANEOUS

Remote Year reserves the  right in its sole discretion to make any determination under these rules, including, without limitation, the determination of your eligibility, a Qualified Referral or Qualified Employer Referral and the amount and payment of fees/credits. If Remote Year determines, in its sole discretion, that you have violated these terms, you will not be eligible for any fees/credits and Remote Year reserves the right to disqualify you from eligibility. Nothing in these terms grants you or any other party any right, title or license to use any of Remote Year’s trademarks or other intellectual property rights.

By submitting referrals or employer referrals, you will not be deemed to be an employee of Remote Year.

You will not  act as an agent of Remote Year nor are you entitled to make any commitments on behalf of Remote Year.

Remote Year reserves the right to amend these rules, including the amount that Referrers are eligible to earn, at any time without prior notice.

You are responsible for the tax consequences, if any, that may result from your participation in the Remote Year Referral Program.

5. DISPUTES

Agreement to Arbitrate: You agree that any claim or dispute in any way arising out of or connected with these terms, with the sole exception of claims brought and litigated in small claims court, shall be referred to and resolved exclusively by binding arbitration to be administered in the English language, in accordance with the Streamlined Arbitration Rules and Procedures of Judicial Arbitration and Mediation Services, Inc. (“JAMS”) then in effect, by one commercial arbitrator who shall be selected from the appropriate list of JAMS arbitrators in accordance with such Rules. Judgment upon the award rendered by such arbitrator may be entered in any court of competent jurisdiction.

Class Action Waiver. Any proceedings to resolve or litigate any dispute under the foregoing will be conducted solely on an individual basis. Neither you nor we will seek to have any such dispute heard as a class action or in any other proceeding in which either party acts or proposes to act in a representative capacity.
